This Notice applies to OneNetworks, Inc., d/b/a Finexio and its corporate affiliates (collectively, together with any of their successors or assigns, “Finexio,” “we,” “our,” and “us”).

Privacy and security are important to us at Finexio. This Privacy Notice (“Notice”) describes how we collect, use, and disclose information about visitors and users of our website at www.finexio.com, and related sites and subdomains thereof (each a “Site,” or collectively, “our Sites”) and any other products or services that are governed by service terms that link to this Notice, including without limitation the General Terms of Service.

TYPES OF PERSONAL INFORMATION WE COLLECT

This Notice does not apply to personal information we collect solely as a service provider in providing our payments platform, products, and related services for businesses (“Services”). In that capacity we are engaged as a service provider and any personal information received from our customers is processed only on behalf of our customers.

Our customers are the controller of such personal information and decide how or why the personal information collected is processed. Where we are a service provider and processor for our customers, our customer agreements and their privacy policies, rather than this one, will be applicable to the personal information processed, and we direct individuals to review those policies if they have any questions around how their data is obtained or processed within the Services or wish to exercise their rights (if any) with respect to that personal information. Please note that we may also act as a processor, or service provider to certain third parties, and you should review the notice of such third parties with whom you are dealing directly, as they will be responsible for the handling of your Information.

In other situations, we receive personal information for our own use. Personal information generally refers to any identifying information that can be linked to an identified or identifiable natural person. Personal information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of personal information varies from one jurisdiction to another.

Personal Information you provide.

Use of the Sites. When you contact our sales team, submit a support ticket for our Services, download a white paper, register for a webinar, apply for a job, or otherwise interact the Sites, we may collect the following types of personal information:

  • Identifiers, such as a real name, unique personal identifier, online identifier, IP address, email address, or account information
  • Personal Information categories such as a name, telephone number or email address
  • Commercial information, such as records of Services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies
  • Payment Data, such as billing details
  • Professional or employment-related information, such as business contact data
  • Other information, such as information you provide in “Request Type” or in the files you upload when you submit a support ticket

Use of Services. When you apply to send or receive payments through our platform, we collect the information you provide to us, which may include your name, email address, phone number, business contact information, and information about persons you intend to pay or from whom you expect payment. If you create an account to log in to our portal, we collect username and passwords data. You can also create an account or login using third party services, such as Google (“Single Sign On” or “SSO”). If you choose to use SSO, we will receive certain information such as your name, email address, and any other information that you authorize us the provider of the SSO to share with us. We use this information to provide the Sites to you and communicate with you. We do not control their privacy practices, so please refer to the terms of use and privacy policy of the SSO. You may disconnect your SSO account from our Sites by contacting us.

Bank account access. Finexio does not collect or store bank login credentials (including usernames, passwords, security tokens, or one-time passcodes) and does not access customer bank accounts. Payments funded by ACH debit or wire are originated and processed by our banking partners pursuant to customer authorization and payment instructions.

Bank account details and payment status information. To facilitate payments and related services, we may collect bank account details that you provide to us (such as account holder name, routing number, account number, and account type) and limited confirmation or payment status information from banking partners and service providers (for example, verification results, settlement status, return or exception codes, and timestamps). We use this information to provide the services, support reconciliation, prevent fraud, and comply with applicable legal obligations.

Personal Information we collect from your financial accounts. The information we receive from the financial product and service providers that maintain your financial accounts varies depending on a number of factors, including the specific Finexio Services, as well as the information made available by those providers. But, in general, we collect the following types of identifiers, commercial information, and other personal information from your financial product and service providers:

  • Financial account information, including financial institution name, account name, account type, account ownership, branch number, IBAN, BIC, account number, routing number, and sort code;
  • Information about an account balance, including current and available balance;
  • Identifiers and information about the account owner(s), including name, email address, phone number, date of birth, and address information; and
  • Information about account transactions, including amount, date, payee, type, quantity, price, location, and a description of the transaction.

Information we receive from your devices. When you use your device to connect to our Sites or our Services, we receive identifiers and electronic network activity information about that device, including internet protocol (IP) address, timezone setting and location, device location, hardware model, operating system, which features within our services you access, browser data, and other technical information about the device. We also use cookies or similar tracking technologies to collect usage statistics and to help us provide and improve our services. Information we receive about you from other sources. We also receive identifiers and commercial information about you directly from other users of our services or other third parties, including our bank partners and service providers. For example, other users attempting to make payments to you using our Services may provide information such as your full name, email address, phone number, or information about your financial accounts and account transactions, and our bank partners or service providers may provide information such as the status of a transaction you have initiated.

Inferences we derive from the data we collect. We may use the information we collect about you to derive inferences. For example, we may infer your location or your annual income or revenue based on the information we have collected about you from you or other sources.

HOW WE USE YOUR INFORMATION

We use your personal information for a number of business and commercial purposes, including to operate, improve, and protect the Sites and Services we provide, and to develop new services. More specifically, we use your personal information:

  • To operate, provide, and maintain our Sites and Services;
  • To improve, enhance, modify, add to, and further develop our Services;
  • To detect, prevent, and protect you, our partners, Finexio, and others from fraud, malicious activity, and other privacy and security-related concerns;
  • To provide customer support to you or our customers, including to help respond to your inquiries related to our Sites or Services, or other requests;
  • To send marketing and promotional materials, including information relating to our Sites or Services, or special promotions;
  • To investigate any misuse of our Sites or Services, criminal activity, or other unauthorized access to our Sites or Services;
  • To comply with contractual and legal obligations under applicable law and/or protect our legal interests and rights;
  • To enforce, establish, or exercise rights described in the service terms that apply to our Sites and Services; and
  • For other notified purposes with your consent.

Although the sections above describe our primary purpose in collecting your information, in many situations we have more than one purpose. For example, we may collect your information to perform our contract with you, but we also collect your information because we have a legitimate interest in understanding who our customers are and what Services we perform on their behalf.

HOW WE DISCLOSE YOUR PERSONAL INFORMATION

We may disclose all categories of personal information described above to the following parties for the purposes identified within this Notice:

  • Affiliates and Acquisitions. We may disclose information to our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or anticipates acquiring, our company, business, or our assets, we will also disclose information to that company.
  • Other Disclosures for Legal Reasons. We may disclose your personal information with your consent to unaffiliated third parties who are not described elsewhere in this Notice.
  • Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also disclose your information in order to enforce, establish, or exercise our rights (including as described in the service terms that apply to our Services), to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the provision of services by a third-party service provider or other intermediary.
  • Service Providers. We may disclose your information to service providers. Among other things service providers may help us to administer our Sites, conduct surveys, provide technical support, process payments, and assist in the fulfillment of account maintenance or change requests.
  • De-identified Personal Information. We may collect, disclose or use aggregated, de-identified data, or anonymized data for any lawful purpose. This includes creating or using aggregated, de-identified, or anonymized data based on the collected information to develop new services and to facilitate research. De-identified information is generally not considered to be personal information under applicable laws.

COOKIES, PIXELS, AND SIMILAR TRACKING TECHNOLOGIES

Every time you come to any of our Sites, our website’s web server automatically collects information, including, in some instances, personal information, through cookies, pixels, web beacons, and other similar tracking technologies (collectively “Trackers”).

Web Beacons

The Sites may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages and/or for other related statistics.

Pixels

Pixels are small transparent images embedded in a site, email or ad and may provide information to platforms who may combine your information with other information they have about you. We use pixels to automatically collect information when you visit our Sites. These technologies usually track advertising preferences from site to site, and gather data about a users’ browsing habits to improve the user experience.

Use of ZoomInfo for Visitor Identification

We use services provided by ZoomInfo Technologies LLC (“ZoomInfo”) to help us better understand and engage with visitors to our Sites. ZoomInfo may collect and process certain information about your visit, including your IP address, to help us identify the business or organization associated with that IP address. This process may involve correlating your IP address with publicly available or licensed business data to infer potential business contact information.

This information is used for our business-to-business (B2B) marketing and sales purposes, such as tailoring our communications and improving our outreach efforts.

Cookies

Cookies are small text files that are placed on your computer or mobile device when you visit a website.

Cookies help the Sites remember information about your visit, which can make it easier to visit the Sites again and make the Sites more useful to you. Some cookies are deleted once you close your browser (session cookies), while other cookies are retained even after you close your browser so that you can be recognized when you return to our Sites (persistent cookies).

Cookies on our Sites are generally divided into the following categories:

Essential Cookies

These are cookies that our Sites need in order to function and that enable you to move around and use the Sites and features. Without these essential cookies, the Sites will not perform as smoothly for you as we would like it to, and we may not be able to provide the Sites or certain services or features you request. Examples of where these cookies are used include: to determine when you are signed in, to determine when your account has been inactive, and for other troubleshooting and security purposes.

Performance Cookies

These cookies enable the Sites to provide enhanced functionality and personalization. They may be set by us or by third party providers whose services we have added to our pages. Still, certain functions or features may become unavailable if you refuse them.

Analytics Cookies

Analytics cookies provide us with information regarding how visitors navigate and interact with our website. Such cookies allow us to understand, for example, more about how many visitors we have to our website, how many times they visit us and how many times a user viewed specific pages within our Sites. Among other Analytics cookies, we use Google Analytics and HubSpot for these purposes. We may use the information collected through cookies and related tracking technologies for the following purposes:

  • To make our Sites easier to use and generally improve its performance.
  • To gather metrics about how you interact with our Sites.
  • For security reasons.
  • To provide personalized content. For example, we may store user preferences, your default language, device and browser information, and your profile information, which includes the level of your usage of the website so we can identify you across devices and personalize the content you see.

Google Analytics

We use Google Analytics to help create reports and statistics on the performance of the Sites. Google Analytics collects information such as your IP address, device type and operating system, referring URLs, location and pages visited. If you don’t want Google Analytics to be used in your browser, you can install the “Google Analytics Opt-Out Browser Add-On,” provided by Google.

Google reCAPTCHA

We use Google reCAPTCHA to protect our Sites from spam and abuse. For example, you may be asked to check a box indicating that you are not a robot or Google reCAPTCHA may detect abusive traffic without user interaction. Google reCAPTCHA works by transmitting certain types of information to Google, such as the referrer URL, IP address, visitor behavior, operating system information, browser and length of the visit, cookies, and mouse movements.

Opting Out of Use of Tracking Technology

You will not be able to opt-out of any cookies that are “essential” for the Sites. However, you can control and/or delete non-essential cookies and Trackers as you wish. Most web browsers automatically accept cookies, but you can usually change your browser settings to prevent this. If you disable cookies or certain Trackers, your ability to use some features of the Sites may be limited. For mobile devices, you may be able to manage certain cookies and Trackers using your built-in mobile device settings and controls. Any choices concerning cookies are browser- and/or device-specific. If you clear your cookies from your browser on any of your devices, your choices will need to be reset. You should check how to do this on your device(s) and operating systems. Some of the advertisers that use advertising cookies for us may participate in the Digital Advertising Alliance (“DAA”) (see http://optout.aboutads.info/?c=2&lang=EN) or the Network Advertising Initiative (“NAI”) (see http://www.networkadvertising.org/choices/).

OUR RETENTION PRACTICES

We retain personal information for no longer than necessary to fulfill the purposes for which it was collected and used, as described in this Notice, unless a longer retention period is required or permitted under applicable law. As permitted under applicable law, even after you stop using a service or terminate your account, we may still retain your information (for example, if we received your information from another user). However, your information will only be processed as required by law or in accordance with this Notice.

HOW WE PROTECT PERSONAL INFORMATION

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts designed to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of any unauthorized access to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Our Sites may permit you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us immediately of any unauthorized use of your password or account.

PRIVACY RIGHTS

A number of US states provide their residents with certain privacy rights. Finexio does not sell your personal information for monetary consideration. To the extent our use of analytics or advertising cookies could be considered a “sale” or “sharing” of personal information, or “targeted advertising,” under certain state privacy laws, you can exercise choices over these technologies through your browser and device controls as described in the “Opting Out of Use of Tracking Technology” section above.

Residents of certain US states may have the right to request:

  • Whether we are processing your personal information, access to that information and to receive a copy of your personal information.
  • Correction of your personal information that is inaccurate.
  • Deletion of your personal information.
  • Opt out of the processing of your personal information for the purposes of providing you with targeted advertising.

We do not use personal information for profiling in furtherance of decisions that produce legal or similarly significant effects for a consumer.

Pursuant to the Nevada Revised Statutes Chapter 603A, we do not currently engage in the sale of any covered information, according to the statute’s defined meaning of a “sale.”

The exact scope of these rights may vary by state. We will not discriminate against you for exercising your rights under the applicable state data protection laws.

Shine The Light Law

If you are a California resident and have an established business relationship with us, California Civil Code § 1798.83 permits you to request information regarding the disclosure of your personal information by us to third parties for the third parties’ direct marketing purposes (as those terms are defined in that statute). To make such a request, please send an email to privacy@finexio.com with the subject line “Shine the Light Request.”

SMS DATA

If you provide your phone number through our Sites, we may use it to contact you for customer service or to send transactional messages related to the products or services you have requested. We do not use phone numbers collected through our Sites to send marketing text messages. Message and data rates may apply. If you receive a text message from us, reply “HELP” for help or “STOP” to opt out. Providing your phone number is not a condition of purchasing any product or service.

We will not sell your phone number, and we will not share it with unaffiliated third parties for their direct marketing purposes. We may share your phone number with service providers that help us deliver the messages described above. You can opt out of any non-essential messages at any time by replying “STOP,” or by contacting us at privacy@finexio.com.

OTHER IMPORTANT INFORMATION

The following additional information relates to our privacy practices:

Changes To This Notice. We may change our Notice and practices over time. To the extent that our Notice changes in a material way, the notice that was in place at the time that you submitted personal information to us will generally govern that information unless we receive your consent to the new Notice. This Notice includes an “effective” date. The effective date refers to the date that the current version took effect.

Links. Our Sites may contain links to other sites. Our Sites may also contain certain social media icons or widgets such as LinkedIn and Youtube. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave one of our Sites and to read the privacy statements of any other site that collects personally identifiable information.

Children’s Privacy. Our Sites are not intended for or targeted to children under 16 years of age. We do not knowingly collect personal information from children under 16. If you learn that a child under the age of 16 has provided us with personal information, then you may alert us at privacy@finexio.com. We will take reasonable steps to delete that information as quickly as possible.

Promotional Emails. Unless you ask us not to, we may contact you via email to tell you about special promotions, new products or services, or changes to this Notice. You may opt-out of any future promotional materials from us at any time by clicking the “unsubscribe” link at the bottom of any promotional email that you receive from us. Please be aware that you will continue to receive certain communications from us that are necessary for our Sites and Services.
